1. Applicability of Terms

1.1) These terms and conditions, herein refers to the user, they form the contract between you and Adway Institute of Management Education Pvt ltd., Course Connect(Collectively hereinafter referred to as the Company) . The site can be accessed through https://courseconnect.in . These terms and conditions govern you even as you access educational courses,career counselling, sessions with industry experts, mock interviews, placement assistance (collectively hereinafter referred to as service(s)) provided by the company. Kindly go through the terms and conditions and other documents incorporated as they govern users by a legally binding agreement between you and the Company.

1.2) In this document the terms “we”, “us” and “our” are references to the Company and terms like “you”, “yours”, “users” are references to people accessing Course Connect. We may change, add, delete portions of these terms and conditions from time to time without even notifying you.

1.3) By impliedly or expressly accepting these Terms of Use, User also accepts and agrees to be bound by the Company policies including but not limited to as amended from time to time and the Applicable Laws. The term “Applicable Law(s)” shall mean any statute, law, regulation, ordinance, rule, judgement, notification, rule of common law, order, decree, bye-law, government approval, directive, guideline, requirement or other governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law of any of the foregoing, by any authority having jurisdiction over the matter in question, whether in effect as of the date of these Terms of Use or thereafter.

1.4) When you use Course Connect you may also be subject to cancellation and refund policy, terms and conditions (hereinafter collectively referred to as “Additional Policies”) of third party/ies, and/or service partner(s) such as institute partner, loan provider partner, transaction partner, technology partner etc.,

2. Alteration of Services

2.1) Course Connect has sole discretion of the Company and the Company reserves the right to add, amend, revise, withdraw, suspend or cancel the usage of this viewable/usable rights of Course Connect either in whole or in part of any other services which are part of Course Connect, without any prior notice to User. Any addition, amendment, revision, suspension, cancellation shall be effective and binding on the User from the date of publication on Course Connect.

2.2) The company may introduce new services(forming part of Course Connect) on Course Connect from time to time without prior notice to the User. The existence and availability of the new services will be notified on Course Connect as and when they will be available.

2.3) It is the responsibility of the User to review these terms and conditions for any updates/changes. Continuing usage of Course Connect following posting of changes will imply that you have agreed to the revised terms and conditions and other policies incorporated. As long as you abide by these terms and conditions the Company grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use Course Connect.

2.4) Kindly note that Additional Policies could be changed by Service Partner(s) at any time without any prior notice. You are required to read all the terms and conditions, policies and additional policies regularly so that you are aware of every new change that may be applicable to you.

3. Account and Registration Obligations

3.1) Access and use of services in Course Connect is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the terms of Indian Contract Act, 1872 are not eligible to use and access Course Connect. If you are a minor under the age of 18, you can access Course Connect use and access Course Connect with prior permission/consent of parents/legal guardian.

3.2) We reserve the right to terminate your account and/or refuse to provide you with access to Course Connect if it's brought to our notice that you are aged under 18 and doing transactions and using services provided by us without prior consent of the parent or legal guardian.

3.3) Registration and/or Account Creation: For accessing contents of Course Connect we may require you to register for availing all the services. You are requested to fill in all the columns and submit the details. The company retains the right to cross-verify the same by asking you to submit the supporting documents. The company also holds the right to terminate registration at its own discretion for any reason, including but not limited to the submission of erroneous/incomplete/derogatory/inappropriate incomplete information.

3.4) User ID and User Password: You shall be able to access services with your registered User ID and password. You must confirm that you are the sole and exclusive owner and the only authorised user of the User ID and User Password and accept sole responsibility for relating to its use, confidentiality and protection as well as for all the account transactions initiated through your account on Course Connect. You will not share your User ID and Password with anyone, and You shall be solely liable and responsible for all the different activities undertaken through your account and any consequences therefrom.

3.5) Retrieve ID/ Password: In case you forget or lose your User ID and Password you shall be able to retrieve by following the recovery procedure on Course Connect. The User undertakes not to disclose the User Password not even to the employees of Course Connect.

3.6) User Undertaking and Obligations: User should duly log-out of the account and close the browser. The Company shall not be responsible for third parties having access to the information.

3.7) Unauthorised Access: You are instructed to use only the legitimate User ID and Password given to you. Use of credentials of other users will be identified as unauthorised access to Course Connect and you will be disabled/barred from using other services. Legal action may be taken as per Applicable law.

3.8) The User will indemnify and hold harmless the Company against all types of losses and damages incurred by the Company due to any action taken by any regulatory body or any public authority due to any erroneous complaint raised by You against the Company with respect to the communications mentioned above or due to a wrong number or email id being provided by You for any reason whatsoever.

4. Course Connect Availability and Communication

4.1) We will do our best to ensure that availability of Course Connect will be uninterrupted and that transmission on Course Connect will be error-free. Sometimes your access to Course Connect and/or the services may be occasionally suspended or suspended or temporarily unavailable for administrative reasons or to allow for repairs, maintenance or introduction of new features and services or any other reason at any time without any prior notice. We will make sure to limit but cannot guarantee the frequency and duration of occurrence of such actions. You must hereby affirm and acknowledge that you shall have no objection.

4.2)By registering, subscribing to us you are agreeing to receive information via sms/whatsapp/email/voice calls as part of normal business operations or use of services. The User hereby unconditionally consents that such communications via SMS, WhatsApp messages, voice call, email or any other mode by the Company are upon the request and authorization of the User and are transactional in nature an not an unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India. I override my NDNC registration (if any) and authorise the Company or its representative to contact me through SMS/ Call/ Email/ WhatsApp messages for any assistance and this will not cause any inconvenience to me.

4.3) When you use Course Connect/send emails/data/information you must understand that you are using electronic records and hereby agree to receive information via electronic records from the company periodically.

4.4) You may opt-out of receiving sms/whatsapp texts/emails/voice calls from us at any time by writing to us at info@courseconnect.in clearly indicating that you are no longer interested in receiving any messages, phone calls. You acknowledge that doing so will also affect the quality of service you receive from Course Connect.

5. Transactions On Course Connect

5.1) You shall at all times be fully responsible for User account transactions carried out by the User ID or User Password registered . Course Connect shall not be responsible for if any third party gains access to any of these information. Therefore, Course Connect indemnifies and holds the company harmless against any loss, liability, costs or damages arising out of actions or claims.

5.2) Any Account transaction made by the registered User ID and Password shall be deemed to be done by you and the company shall treat the transaction to be genuine. If any transaction is carried out incorrectly you must notify the company immediately.

5.3) Evidence of transactions shall be maintained through computer systems.

5.4) All transactions will be subjected to the Government Notifications, rules, guidelines issued by the Reserve Bank of India (RBI) .

5.5) Transactions if carried out at Cyber Cafes or shared computers are risky and Course Connect advises you not to carry out transactions at such places. The company shall not be liable for any fraudulent transactions committed at such terminals or machines.

5.6) Account registration and legal actions: We may at our sole discretion suspend, block, restrict, cancel the account of such User and/or disqualify that User and any related User(s) who files an invalid and/or false claims or provides false, incomplete, or misleading information. We reserve our right to initiate civil and/or criminal proceedings against such Users. In addition to the legal proceedings as aforesaid, we reserve the right to seek prosecution of any person who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information and may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.

6. Payment and Payment Terms

We accept payment modes depending on your location. All the payments are subjected to the application of Goods and Services Tax (GST) . By proceeding for transactions at Course Connect you shall use the payment methods provided by us. We may refuse any process midway if the transacting authority has a history policy breach. All valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the User and the respective issuing bank and payment instrument issuing company.All online bank transfers from valid bank accounts are processed using the gateway provided by the respective issuing bank which supports a payment facility to provide these services to the users. All such online bank transfers on payment facilities are also governed by the terms and conditions agreed to between the User and the respective issuing bank.

7. User Representation and Warranties

You must understand, agree and confirm that you shall not host, display, modify, publish, transmit any information that belongs to another person to which the User does not have any right. You must not host, display, modify, publish and transmit any information that is deemed/ could be interpreted to be defamatory, obscene, pornographic, pedophilic, invasive of other’s privacy, including bodily privacy, insulting or harassing on the basis of gender, sexuality, race, ethnicity, encouraging money laundering, gambling, inconsistent with the laws. Nothing you do should be harmful for a child, infringes patent, trademark, copyright or other proprietary rights. You shall not do anything that deceives, misleads, violates the laws in force. No action done by you should threaten the unity, integrity, sovereignty of India, its friendly relations with foreign states, public order, public morality or cause incitement to any criminal offence or prevent investing of offences or insulting other nations. You must not host, display, modify, publish, transmit any information that contains viruses, malwares designed to interrupt, disrupt the functionality of a computer resource.

You further agree, undertake, warrant and confirm that you shall not use any device that interrupts the proper functioning of Course Connect or imposes a huge load on the infrastructure of the company( physical or virtual). Any attempt to reverse look-up, trace, or seek information on any user or visitor of Course Connect, or any other customer of the company, including any login account not owned by you, to its source, or to exploit Course Connect or any service or information made available or offered by or through Course Connect, for purposes other than accessing your own information provided for by Course Connect, is strictly prohibited. This includes using any automated device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of Course Connect or any content, or to reproduce or circumvent the navigational structure or presentation of Course Connect or any content, in an attempt to obtain materials, documents, or information through any means not purposely made available through Course Connect. Unauthorised attempts to gain access to any portion or feature of Course Connect, or any other systems or networks connected to Course Connect or to any company server, or to any of the services offered on or through Course Connect, by hacking, password "mining," or any other illegitimate means, are strictly prohibited. Additionally, attempting to forge headers or manipulate identifiers to disguise the origin of any message or transmittal sent to the company through Course Connect, or any service offered on or through Course Connect, is not permitted. Impersonating any other individual or entity, or using Course Connect or any content for unlawful purposes, or to solicit the performance of illegal activities, is also prohibited. Introducing or causing to introduce any computer contaminant, and by means of such conduct causing or likely to cause damage or destruction to Course Connect property or disruption of Course Connect services, is strictly prohibited. Similarly, knowingly or intentionally penetrating or accessing Course Connect network or systems without authorization, or exceeding authorised access, and by means of such conduct, carrying out unauthorised transactions or obtaining access to restricted information, data, or computer databases, is strictly prohibited. Interfering with services provided to any user, host, or network, or carrying out denial-of-service (DOS) attacks, including but not limited to flooding networks, deliberate attempts to overload a service, or attempting to crash a host, is strictly prohibited. Any such conduct that violates these terms of use will result in immediate termination of access to Course Connect and may also result in legal action.

8. Intellectual Property Rights

Unless explicitly stated otherwise, all materials, including images, illustrations, designs, icons, photographs, music, video clips, audio materials, text, trademarks, logos, directories, charts, guides, excerpts, opinions, critiques, reviews, made available through Course Connect (referred to collectively as the "Content"), are protected by copyrights, trademarks, and/or other intellectual property rights owned, controlled, or licensed to the Company, its subsidiaries, affiliates, and advertisers. The Content or information available on Course Connect is intended solely for your personal, non-commercial use. You are prohibited from copying, reproducing, republishing, uploading, posting, transmitting, or distributing such Content or information in any manner, including via email or other electronic means, whether directly or indirectly, and you must not assist any other person in doing so. Modification of the Content or information, use of the Content or information on any other platform or networked computer environment, or use of the Content or information for any purpose other than personal, non-commercial use without the prior written consent of the Company is a violation of copyrights, trademarks, and other proprietary rights and is strictly prohibited.

9. Data Privacy

Regarding our handling of any personal information/data you provide to us, it will be conducted in accordance with our Privacy Policy. This Privacy Policy is an essential component of the Terms of Use and should always be considered alongside them. We kindly request that you review our Privacy Policy, which also regulates your visit to Course Connect.

10. Feedback/Submissions

You must acknowledge and confirm that all questions, comments, suggestions, feedback or any other information regarding Course Connect and its service(s) provided by you are non-confidential. We and our associated third parties shall be entitled to worldwide unrestricted use and dissemination of these feedback/submissions for any purpose, commercial or otherwise without acknowledging you or providing you with compensation.

11. Downloads

Please be advised that any downloads offered are intended solely for promotional, journalistic, and/or reporting purposes concerning Course Connect and may not be utilised for any other intent. All downloads, including software, multimedia files, photographs, reports, and other documents, are obtained at your own discretion. Course Connect does not guarantee the suitability of any such downloads and assumes no liability in this matter.

12. Disclaimer

Course Connect, along with its services and any information provided to users through Course Connect, is offered on an "as is" and "as available" basis. Your use of Course Connect and our services is solely at your own risk. We make no representations or warranties of any kind, whether express, implied, statutory, or otherwise, regarding the service offerings or the third-party content. We disclaim all warranties, including any implied or express warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, or quiet enjoyment, arising out of any course of dealing or usage of trade. We do not warrant that Course Connect will be uninterrupted, timely, secure, or error-free, or that the information published on Course Connect is complete, true, accurate, or non-misleading. We do not guarantee the quality of any products, services, information, or other material purchased or subscribed by users through Course Connect, nor do we warrant that any errors in the service will be corrected. As with the purchase of a service through any medium or in any environment, users should use their best judgement and exercise caution where appropriate.

13. Indemnity and Release

By agreeing to these terms, you commit to protecting, compensating, and absolving Course Connect, its subsidiaries, and affiliates, along with their respective directors, officers, employees, service providers, representatives, and agents (collectively referred to as "Indemnities"), from any claims, losses, damages, liabilities, or demands, including reasonable attorney fees and expenses, arising from your use of Course Connect and/or its services. This includes situations where your use violates the Terms and conditions, Privacy Policy, or other policies, or infringes upon any laws, rules, regulations, or the rights (including intellectual property rights) of a third party. You expressly release the Indemnities from any consequences resulting from the actions or inactions of third parties or service partners related to Course Connect. Additionally, you waive any claims or demands against the Indemnities under any statute, contract, or other legal basis.

14. Jurisdiction

Your usage of Course Connect and terms and conditions will always be governed by Indian Laws and all disputes shall be subject to exclusive jurisdiction of courts at Bangalore. The Company assumes no responsibility, whether direct or indirect, for any failure to comply with the laws of countries other than India. Simply accessing Course Connect from a country other than India does not imply that the laws of that country govern these Terms and conditions of Course Connect. The Company's adherence to these terms and conditions is contingent upon compliance with existing laws and legal processes. This does not impede the Company's ability to adhere to governmental, court, and law enforcement requests or requirements pertaining to your use of Course Connect or information gathered by the Company in relation to such use.

15. Dispute Resolution

In matters concerning the Services provided by you under these Terms and Conditions, including disputes regarding the interpretation and validity of these Terms and Conditions, any disputes, controversies, or claims arising will be initially resolved through mutual discussion in an amicable manner. If mutual discussion fails to resolve the issue, it shall then be settled exclusively through courts located in Bangalore. This applies to all disputes or controversies related to or arising from the Services offered by Course Connect.

16. General

In entering into a bipartite contract with Service Partner(s), you acknowledge that the agreement between you and the Service Partner(s) is two-sided. You understand that Course Connect acts solely as a facilitator and holds no responsibility or control over any contractual obligations between you and the Service Partner(s). Any defaults, including non-repayment or misappropriation of funds, are your sole responsibility and accountability to the Service Partner(s).

All times mentioned in any service offerings on Course Connect are in accordance with Indian Standard Time (IST), unless otherwise specified. IST refers to the time observed throughout India, which is GMT+5:30.

You are not permitted to assign your rights and obligations under these terms and conditions to anyone. However, Course Connect reserves the right to assign its rights and obligations under these terms and conditions at its sole discretion and without advance notice to you.

Course Connect retains the right to store 'cookies' on your system during the use of its services. These cookies allow for automatic user identification upon subsequent use of Course Connect. You have the option to block or delete cookies by adjusting your browser settings accordingly.

Nothing within these terms and conditions, or any related arrangements, shall be construed as creating an employer-employee relationship, principal-agent relationship, or partnership between the parties for any purpose, nor does it entitle either party to commit or bind the other in any manner.

The words 'including' or 'include' and words of similar effect shall not limit the general effect of the words following them.

Headings are provided for reference purposes only and do not define, limit, construe, or describe the scope or extent of any section. They do not affect the interpretation of any section.

If any part of these terms and conditions is deemed void, voidable, illegal, invalid, or unenforceable under applicable laws, that part shall be severed, and the remainder of the terms and conditions shall continue to be valid and enforceable.

Any disclaimers and exclusions contained within these terms and conditions will survive termination of the agreement.

Failure by Course Connect to exercise any right or remedy under these terms and conditions shall not prevent Course Connect from doing so at any time in the future.

By using Course Connect, you affirm and acknowledge that the availability of information, advice, and guidance does not constitute a recommendation or solicitation by Course Connect, its personnel, or experts. The decision to select any courses offered by Course Connect is solely at your discretion, and you have not been directed or forced to select any courses by Course Connect or its employees.

These terms and conditions constitute an electronic record in terms of the Information Technology Act 2000, as amended from time to time, and rules framed thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures.
